Z.ONE concept™ Minimum Advertised Price Policy

Z.One Concept (“Z.One”) has unilaterally adopted a Minimum Advertised Price Policy (“MAP Policy”) for all Z.One branded products offered for sale by resellers, dealers, and distributors in the United States (“Merchants”). 

1. Products Subject to MAP Policy

This MAP Policy applies to all Z.One branded products currently available for purchase on Z.One’s website located at (each a “MAP Product,” collectively “MAP Products”).  The Minimum Advertised Price for each MAP Product is the price at which Z.One currently sells the MAP Product on its website located at  Minimum Advertised Prices are established by Z.One unilaterally and may be adjusted by Z.One at such times and in such amounts as it may determine in its sole discretion.

2. Resellers Subject to MAP Policy

This MAP Policy applies to sales of MAP Products made directly by Merchant, and also to sales made by other individuals or entities who purchase MAP Products from Merchant for the purpose of resale.  Z.One expects Merchants with a direct purchase relationship with Z.One to communicate this MAP Policy to any downstream reseller receiving MAP Products from Merchant, and Merchant shall be responsible for any such downstream retailer’s adherence to this MAP Policy.

3. Advertisements Subject to MAP Policy

This MAP Policy applies to all advertisements of MAP Products in any and all media, including, without limitation, flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, mail-order catalogs, internet or similar electronic media including websites, electronic “marketplaces,” email newsletters, email solicitations, television, radio and public signage. 

This MAP Policy does not apply to: (a) any in-store displays and advertising, including, but not limited to, signage, price tags, or prices written in a sample book, as long as such displays and advertising are not distributed to any customers; (b) prices displayed at the point of sale in store or on the internet (such as when a product is added to a “cart” as long as the shopping cart technology does not allow a below Minimum Advertised Price to be displayed as a search engine result or otherwise revealed to the general public outside of the point of sale); (c) any advertisements by Merchants that “they have the lowest prices” or, they “will meet or beat any competitor’s price,” that consumers should “call for a price” or phrases of similar meaning as long as the price advertised or listed for the product is not less than the Minimum Advertised Price; and (d) Merchant’s direct responses to consumers’ inquiries regarding actual pricing of MAP Products.

4. Minimum Advertised Price Guidelines

Prices advertised and communicated to the public must be equal to or greater than the applicable Minimum Advertised Price as set by Z.One from time to time.  Z.One’s current Minimum Advertised Prices for MAP Products are the prices at which Z.One sells its products on its website

This MAP Policy applies only to advertised prices and does not apply to the price at which MAP Products are actually sold or offered for sale to a customer.  Merchants remain free to sell Z.One branded products to consumers at any price in their sole discretion. 

From time to time, Z.One may discontinue products or engage in promotions with respect to particular MAP Products.  Z.One reserves the right to unilaterally suspend or modify application of this MAP Policy with regard to such MAP Products by notifying Merchants of any such suspensions or modifications.

5. Violations of MAP Policy

Z.One may cancel any pending orders, restrict future orders, or suspend a Merchant’s account with Z.One if Merchant violates this MAP Policy.  Z.One will monitor and enforce compliance with this MAP Policy unilaterally and will not accept or discuss reports or complaints regarding alleged violations of this MAP Policy or requests to enforce this MAP Policy from any third parties.

6. MAP Policy Unilaterally Set and Uniformly Enforced by Z.One

This MAP Policy has been adopted and implemented unilaterally by Z.One.  Z.One is not soliciting, and will not accept, agreement from any Merchant to adhere to this MAP Policy.  It is entirely within the discretion of the Merchant whether to comply or not comply.

What is a MAP policy?

A MAP policy is set of pricing guidelines that dictate the minimum price at which resellers can advertise covered products.  A MAP policy does not apply to actual sale prices and resellers remain free to set their sale prices in their sole discretion. 

Why has Z.One instituted the MAP Policy?

Z.One has instituted its MAP Policy to safeguard its brand’s value and integrity.

How does Z.One enforce the MAP Policy?

Z.One actively monitors the prices advertised by Merchants.  When Z.One discovers a violation of this MAP Policy, Z.One will contact the Merchant directly as part of its investigation into the MAP Policy violation.  Merchants are expected to comply with any such MAP Policy violation inquiries from Z.One.  Z.One, in its sole discretion, may penalize any non-compliant Merchants, including by cancel any pending orders, restrict future orders, or suspend a Merchant’s account with Z.One if Merchant violates this MAP Policy.

How often does Z.One update its list of MAP Products and Minimum Advertised Prices?

Z.One usually updates its list of MAP Products and associated Minimum Advertised Prices once per year but may make other updates to the list from time to time in its sole discretion. 

Do promotional incentives that are contingent upon the purchase of a MAP Product violate the MAP Policy?

Coupons, gift cards, loyalty points or other similar incentives are compliant with the MAP Policy as long as they are applied to the entire purchase at the point of sale.  Advertisements that indicate the price after the discount or incentive has been applied, however, violate the MAP Policy. 

What does the MAP Policy apply to?

The MAP Policy applies to all advertisements of covered Z.One branded products.  All Z.One products currently offered for sale on Z.One’s website at are covered by this MAP Policy.  The Minimum Advertised Prices for the covered products are the prices at which Z.One sells such products on its website at

What are some examples of violations of the MAP Policy?

The following is a non-exclusive list of practices that constitute violations of this MAP Policy: 

  • Advertising a price for a MAP Product that is below the applicable Minimum Advertised Price for that product;
  • Advertising free or discounted products or services included or “bundled” with other Z.One products if the inclusion of such products or services would lower the net price of the covered MAP Product below the Minimum Advertised Price;
  • Advertising a price for a MAP Product with any strike-through or other alteration of the Minimum Advertised Price;
  • Listing a MAP Product for sale on an auction site with advertised “buy it now” or similar pricing below the applicable Minimum Advertised Price;
  • Advertising that suggests or implies that a price below the applicable Minimum Advertised Price is available; and
  • Advertising a price for any MAP Product lower than the applicable Minimum Advertised Price on any email, website, or other electronic means in any way that is visible by any viewer before the MAP Product is placed in a shopping cart or other electronic point of sale.
